Who This Applies To
This Privacy Policy and Terms of Service apply to two distinct groups of users:
Builders are users who sign up for FlowAgently accounts to create, configure, manage, and deploy AI chatbots on their own websites or applications. This includes anyone who accesses our platform, dashboard, and builder tools.
Chat Users are end-users who interact with AI chatbots that have been embedded on third-party websites using our widget. These individuals do not have FlowAgently accounts and only engage with the chat interface.
Throughout this document, we indicate which provisions apply to builders, chat users, or both. When no distinction is made, the provision applies to all users.

Overview
(Applies to both builders and chat users) We respect your privacy. This policy explains what information we collect, why we collect it, and how we handle it when you use our platform to build chatbots (builders) or interact with embedded chatbots (chat users).
Information we collect
(Applies to both builders and chat users) The information we collect varies depending on how you use our service:
- For builders: Account and contact information you provide (e.g., email) when signing up, chatbot configuration settings, website URLs provided for crawling, and usage analytics.
- For chat users: Chat content you send to the bot, including prompts and feedback, and any information you choose to share during conversations.
- For both: Technical information such as device, browser, and interactions necessary to provide the service.
How we use information
(Applies to both builders and chat users) We use the information we collect for different purposes depending on your role:
- For builders: To provide and maintain your account, enable chatbot creation and management, process website content you submit, and communicate with you about updates, features, and support.
- For chat users: To deliver AI-generated responses to your questions, improve chatbot accuracy and performance, and ensure the chat experience functions properly.
- For both: To secure our service, prevent abuse, debug technical issues, and comply with legal obligations.
Sensitive information
(Primarily for chat users) Do not submit sensitive personal information in the chat interface (for example, passwords, government IDs, payment card numbers, health data, or other confidential information). The chat is designed for general assistance and product support only. (For builders) When configuring chatbots, ensure you do not include sensitive data in knowledge base content or system prompts.
Analytics
(Applies to both builders and chat users) We use minimal analytics to understand how our service is used and to improve functionality:
- For builders - Website analytics: We may set the _tcc1_visitor cookie to track basic site usage patterns when you visit our platform. This requires your consent and can be disabled via our cookie banner.
- For builders - Dashboard analytics: We track usage of builder features, chatbot configuration activities, and deployment status to improve the platform experience.
- For chat users - Embedded chatbots: When our widget is installed on customer websites, we measure operational analytics such as message counts, latency, and error rates necessary to deliver and improve the service.
- Demo interactions: We do not track interactions with bots shown on our landing page or demo page where no user ID is associated.
We do not use marketing trackers. (For builders) If you enable end-user identification or bring your own analytics for chat users, your privacy and cookie policies apply as the data controller; we act as a processor.
Storage and retention
(Applies to both builders and chat users) We store data in our application databases (e.g., Supabase). For builders, we retain account information, chatbot configurations, and related data while your account is active and for a reasonable period thereafter. For chat users, we retain conversation logs as determined by the builder's retention settings or as necessary to improve service quality. We retain all data only as long as needed for the purposes described above or as required by law.
Cookies and local storage
(Applies to both builders and chat users) We use cookies and localStorage differently depending on your interaction with our service:
Cookies
- Essential cookies (both): dps_site_id (server routing), cookie_consent (your preferences)
- Analytics cookies (for builders): _tcc1_visitor (site usage analytics, requires consent)
localStorage
- For chat users: Remembering whether the chat widget is open or closed, and saving conversation state
- For builders: Storing your authenticated session when using our platform and dashboard, and saving your cookie consent preferences
localStorage data stays in your browser and is not transmitted to our servers.

Data processors
(Applies to both builders and chat users) We use trusted service providers to host and process data. These providers process data on our behalf under appropriate agreements.
- Supabase (authentication, database, and storage) - For builders: hosts your account and chatbot configuration data. For chat users: may store conversation logs.
- OpenAI (model inference) - For chat users: Chat prompts and relevant context may be sent to OpenAI API to generate chatbot responses and deliver the service. OpenAI does not use API data to train their models by default.
- Google (Gemini) (model inference) - For chat users: Chat prompts and relevant context may be sent to Google APIs to generate chatbot responses and deliver the service.
We reserve the right to change, add, or remove data processors without prior notice as necessary to operate and improve our service.
Your rights
(Applies to both builders and chat users) Depending on your location, you may have rights to access, correct, delete, or export your data, and to object to or restrict certain processing. Builders can manage their account data through the dashboard. Chat users should contact the website owner where the chatbot is embedded, or contact us directly for assistance. To exercise these rights, contact us.

Agreement
(Applies to both builders and chat users) By accessing or using our services, you agree to these Terms. Builders agree to these Terms when creating an account and using our platform to build and deploy chatbots. Chat users agree to these Terms when interacting with chatbots embedded on third-party websites. If you do not agree, do not use the service.
Subprocessors
(Applies to both builders and chat users) We use third-party providers to operate the service, including Supabase (authentication, storage), OpenAI (model inference for chatbot responses), and Google (Gemini) (model inference for chatbot responses). By using the service, you authorize us to use these providers to process your data to deliver the functionality. Builders acknowledge that content they provide and chatbot conversations will be processed through these services. Chat users acknowledge that their messages will be sent to AI providers to generate responses.
Acceptable use
(Applies to both builders and chat users) You agree to use our service responsibly:
- For both: No unlawful, harmful, or abusive behavior.
- For both: No attempts to reverse engineer or disrupt the service.
- For chat users: Do not submit sensitive personal data in conversations unless necessary.
- For builders: You are responsible for ensuring chatbots you create comply with applicable laws and do not violate third-party rights. Do not configure chatbots for illegal or harmful purposes.
AI outputs
(Applies to both builders and chat users) AI-generated responses may be incorrect, incomplete, or misleading.
AI-generated content does not constitute legally binding commitments, contracts, agreements, professional advice (including legal, medical, financial, or other professional guidance), or any form of guarantee. We expressly disclaim any liability for decisions made or actions taken based on AI-generated content.
Chat users are responsible for verifying all information before acting on it and should not treat AI responses as authoritative or binding. Builders must inform their own users about these limitations and ensure their chatbots include appropriate disclaimers about the non-binding nature of AI-generated content.
Intellectual property
(Applies to both builders and chat users) The FlowAgently platform, including content, logos, and code, is owned by us or our licensors. Builders retain ownership of the content, configurations, and data you provide to create chatbots, but you grant us a license to process and store it to provide the service. Chat users retain ownership of messages you send, but grant us a license to process them to generate responses.
Content sources and crawling
(Applies to builders only) When you input a website URL to create a chatbot, you represent and warrant that you have all necessary rights and permissions to crawl, scrape, and use the website content for the purposes of operating your chatbot. You are solely responsible for ensuring that your use complies with applicable laws, the website's terms, and robots.txt or similar directives. We do not control, direct, or assume responsibility for your scraping activities or any claims arising from them.
Disclaimers and liability
(Applies to both builders and chat users) The service is provided "as is" without warranties. To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Builders are responsible for how they configure and deploy chatbots to their users. Chat users use chatbots at their own discretion.
Termination
(Applies to both builders and chat users) We may suspend or terminate access if you violate these Terms or if required for security or legal reasons. For builders, this means we may suspend or close your account and disable your chatbots. For chat users, access to specific chatbots may be restricted by us or by the builder who deployed them.
